2. Declarations of Interests
None
3. Minutes of last meeting
The minutes of the last meeting on 13 August 2009 were agreed and signed.
4. Report of actioning of items from previous minutes
AP10- fence on Recreation Ground The hedge has been removed and the fence built onto Recreation Ground land. Cllr Herbert has raised the matter with the EBC Enforcement Team and Cllr Michael Courtney has raised it with the EBC Legal Dept. The CRGT have passed the matter onto EBC as they are the landowners.
AP11-application for gates to Esher Park Avenue The response from the Highways & Transportation Committee was that there was no objection to the closure of the road to vehicular traffic, but that the pedestrian and cycling route should remain totally unobstructed, as this is a safe route to Esher. The application has since been refused by the Officer. A similar application for lower gates was also refused. Sandown Park Avenue applied for new gates similar to the existing ones, and these were permitted. If other roads in this locality make applications, we should submit comments similar to those for Esher Park Avenue.
All other actions have been carried out.
5. Correspondence
5.1 A letter has been received from EBC with regard to 60, Stevens Lane. The agent for the site and the new owners have been made aware that conditions attached to permissions 2007/2084 and 2008/0404 remain outstanding. The close boarded fence does require planning permission to be retained at its current height, but the Officer will not take enforcement action. With regard to the trees, should any health problems arise as a result of the development, the Council has a five year period to take action under the relevant landscaping provisions of the relevant planning permissions.
5.2 All the recent results from the EBC were read.
5.3 Amended plans were submitted for 11, Cavendish Drive. The Officer asked this Committee to comment when the amended plans were received by EBC, but it was agreed no comments should be made until discussed at a correctly constituted meeting. The amended plans were studied and it was agreed that there are no objections to the new plans.
AP12 The Clerk to forward comments to the Officer.
5.4 Richard Fletcher, the Officer in the case of the application 2009/1246 for felling of a tree at 3, Claygate Lodge Close asked for a site meeting. Cllr Herbert attended on behalf of CPC. Vanessa and Chris Relleen were also present. EBC are minded to remove the TPO. The fate of the tree will now rest on negotiations between the residents of numbers 2 & 3 Claygate Lodge Close. The owners of number 2 want the tree removed as it is allegedly causing subsidence problems, but removal of the tree could also adversely affect the houses because of heave. It is believed that the owners of the tree will discuss the matter with their insurers.
There will be no change to the comments put forward by this committee, as the planning view is that the tree should be retained.

7. Report of the East Area Sub Committee
The meeting was on 17 Aug 2009, Cllr Herbert attended. He gave a report to the meeting.
Cllrs Cartwright and Courtney were not at the meeting, so Claygate was represented by Cllr Wells.
i. Foley Arms PH application –permitted. Cllr Wells stated there was better separation of new & old, and there were no parking or transport issues. He will try to arrange a meeting between Young’s and the Boxing Club to see if another venue can be found for the club.
Cllr Huddart declared an interest as he is a member of Probus, and Probus will be disadvantaged by the proposal as the building work will take several months and there is doubt as to whether the function room will be large enough for their future needs or will be affordable.
i. 2 Stevens Lane –permitted as this was a better use of housing.
8. Licensing Applications

9. Enforcement
9.1 The removed hedge and fence in the Recreation Ground. It is not known whether the householder is aware that the hedge is part of a historic hedge, and may be an offence to remove. As a third party, we can only show concern. EBC is involved in two ways, both as the landowner and as the Planning Authority.
9.2 The application to change the shop front of the Londis was submitted in May of this year and was granted, yet no work has begun. Cllr Herbert will enquire from EBC as to whether there is any timescale laid out for the alterations.

10. Village Design Statement
The draft has gone out for consultation which will end on the 14 Sept 2009. No comments have yet been received.
11. Matters for information only
There are four applications for Claygate at the EA Sub- Committee on Monday; Keeran, Raleigh Drive, 158, Hare Lane, Claygate Tennis Club and 43, Rythe Road- all are recommended permit by the Officers.
