2. Declarations of Interests
Cllr Huddart declared that he is the Acting-Chairman of the Claygate Conservation Areas Advisory Committee.
3. Minutes of last meeting
The minutes of the last meeting on 3 September 2009 were agreed and signed.

All the recent results from the EBC were read.
6. Current applications and Declarations of interest
The Chairman changed the order of the weekly lists to hear public speaking from Mr Krishnan. He spoke for application 2009/1598-64,

A similar previous proposal was refused on appeal as the building was too large for the site causing detriment to the character of the area and to the residential amenities of some neighbouring properties. This proposal is larger and therefore, must fail on the same grounds.

10. Gambling Policy Consultation
On 6th December 2006, in accordance with the Gambling Act 2005, Elmbridge Borough Council adopted its first Gambling Policy (also referred to as a Statement of Principles) which was published on 29th December 2006. This policy is reaching the end of its third year and The Council is required to review the Gambling Policy every three years.
The Gambling Policy shows how the Council carries out functions in support of the government's objectives, which are:
· preventing gambling from being a source of crime and disorder, being associated with crime and disorder, or being used to support crime.
· ensuring that gambling is conducted in a fair and open way.
· protecting children and other vulnerable persons from being harmed or exploited by gambling.
As part of the adoption process specific organisations are consulted, such as:
· the Police
and organisations representative of residents, businesses and people already involved in gambling activities within the Borough etc.
Summary of main changes

The consultation for this is from 7 September to 15 October 2009.
It was noted that the policy not to have casinos in the Borough is time limited. There is no reference to renewing this policy. It was agreed that we should ask that this ‘no casino’ policy is renewed in respect of residential areas.
It was agreeed that Cllr Herbert should contact Martin Parker regarding this matter.

The Casinos/Gambling Policy consultation originates from our Environmental Health & Licensing Division so I have forwarded your comments on behalf of Claygate Parish Council to my colleague Tony Deag, Head of Environmental Health & Licensing.
11. Enforcement
11.1 Cllr Herbert noted that EBC are reviewing their Enforcement Process in November. It was agreed that we want to know what form the consultation will take; will EBC ask for comment or should we forward them.

I understand the November general consultation on the Councils Enforcement Policies is not yet confirmed and in any case is not likely to drill down to specific details on, for example, Planning Enforcement Policy. However, I can confirm that we in Planning currently are working on an updated Planning Enforcement Charter or Protocol dealing with specific response times, priorities etc. That will certainly be the subject of local consultation before it is adopted and I will ensure the Parish Council is included. The draft is currently 'work in progress' as we have been diverted on LDF work so I anticipate the consultation will not occur before early 2010.
11.2 Outstanding enforcement actions:-
i. Shop front of the Londis The application to change the shop front of the Londis was submitted in May of this year and was granted, yet no work has begun. Cllr Herbert made enquires with EBC as to whether there is any timescale laid out for the alterations. Jane Farquharson, Enforcement Manager, replied that a letter was sent to the owners on 8 Sept this year. The enforcement case on this was re-opened following the approval of the amended shopfront and signage scheme. The case officer is MorwennaTaylor and the intention is to now write to the owners to agree a timetable for the alterations to be undertaken. Following this the site will be monitored for compliance. Morwenna Taylor will advise of the outcome of this so that you are aware of the timetable.
ii. The removed hedge and fence in the Recreation Ground. Cllr Herbert contact EBC Enforcement, but the Officer was merely concerned with the fence itself which is within permitted development and did not comment about the removal of the hedge o r the land grab. Cllr Courtney contacted the legal dept at EBC, but we do not know of the outcome. It was agreed to ask the Enforcement Officer if she has spoken to the EBC Tree Officers about the hedge and to mention this matter to Martin Parker.
It was agreed to raise Enforcement action at the next EBC/CPC Liaison meeting in October.
12.1The consultation ended on the 14 Sept 2009. Noel has collected all the copies and comments. Not many comments were received.
12.2 After the recent problems of removal of what may be a 200 year old hedge, it has been decided to include the hedgerow survey map of 1997 together with a further note.
12.3 The basic document will become the reference document for architects and developers.
12.4 After the comments have been taken into account, the revised document will be again scanned for errors and spelling mistakes. The further revised document will be readied for 16 Oct which will give two weeks for it to be circulated in hard-copy to Councillors prior to the PC meeting in November. The website document will also be revised, so that Councillors can view this.
13. Matters for information only
13.1 Cllr Round thanked the Clerk and Sam Collins for delivering 3 planning letters.
After the grant of planning permission anyone with an interest in the site can apply under the new s96A of the Town and Country Planning Act for a non-material change to that permission (a system previously referred to as a minor amendment).
All such applications will need to be made on the new standard planning applications forms (1APP), which will be published on 1 October 2009. The applicant will need to notify any other person who is an owner of the land to which the application relates when they make their application and the Council will determine their application within 28 days of receipt.
A new application procedure has also been provided to allow applicants to 'replace' existing planning permissions which have not yet begun and which have not yet expired.
Most planning permissions are granted subject to a condition that they be begun before the expiry of three years from the date of grant. This new application allows an applicant to replace this with a new period to keep the grant of planning permission alive under a new application under s73 if the Town and Country Planning Act.
All such applications will need to be made on a new standard planning application form (1APP), which will be published on 1 October 2009. The applicant will not need to automatically provide new plans or supporting information, though the Council may ask for necessary information for consultation and determination purposes if the circumstances of the application have changed. A new schedule of fees is again anticipated later this year and prior to this the standard fee for applications of this type, £170, will be charged.
13.3 Cllr Round wondered why CPC has only 3 weeks to comment to EBC when EBC take about 8 weeks to process planning applications. The Government sets time limits for processing of applications; those Planning Authorities who are tardy lose a grant. As EBC have administrative work to carry out on the applications, they allow three weeks for comment.
