1. Apologies for Absence

2. Declarations of Interests

3. Minutes of last meeting

The minutes of the last meeting on 24 September 2009 were agreed and signed.


4. Report of actioning of items from previous minutes

AP14- Cllr Herbert to contact Martin Parker re gambling Policy-reply received.

AP15- Cllr Herbert to contact Martin Parker re Enforcement-reply received.


5. Correspondence

5.1 An appeal has been received in respect of land at 158, Hare Lane 2009/1200. The Clerk will write to the Inspectorate for a copy of the result.

5.2 All the recent results from the EBC were read.


6. Current applications and Declarations of interest

6.1 2009/1625 – Ahimsa, Ruxley Crescent –one detached two storey house and one detached part two/part three storey house following demolition of existing house.

We have no comment on the building proposals but all trees should be retained. Their protection during construction is detailed in the plans; a no-dig driveway, ground protection under T9 and protective fencing around other trees. This protection should be a condition of any consent and should be enforced.


6.2 2009/1661– 50, Stevens Lane- two storey /part first floor side extension, and new hipped roof over existing front garage.

No comment


6.3 2009/1669 – 57, Vale Road LDC-whether permission is required for proposed hipped to gable roof extension incorporating two rear dormer windows

We believe this should not be an LDC as it breeches planning rules. The proposal will be visible from the street and is out of keeping with the streetscape. The proposal will also lead to overlooking to a neighbouring property which would result in a loss of privacy which would be harmful to their residential amenity.

6.4 2009/1684– 9 Stevens Lane part single/part two storey side extension and single storey rear extension following demolition of conservatory and garage

No comment.


6.5 2009/1715– 60, Hare Lane additional two storey house following demolition of garage

We have no objection to the application, but note that the garden of the new house will be small, so ask that permitted development rights be withdrawn.

6.6 2009/1752– Claygate Station, The Parade-roller shutters to front & side elevations

Claygate Station is a period building, over 130 years old. We object to this proposal as the shutters will be out of keeping on this historic, late-Georgian structure.


6.7 2009/1773– 23, Glenavon Close-two storey side/rear extension and 2 front dormer windows.

We object to this application as it breeches the 1m rule to the neighbouring property at no. 21 and the design is totally out of keeping with the street scene. We ask the Officer to check the overlooking and loss of privacy to no.21 from the new first floor windows.


6.8 2009/1775– 12, Vale Road-single storey rear extension and pitched roof over existing single storey rear extension

No comment.


6.9 2009/1787– 41A, Telegraph Lane-detached garage

No comment.


7. Report of the East Area Sub Committee

Cllr Ken Huddart attended. He circulated a report prior to the meeting.

There were 2 applications for Claygate:-

Jimmy Cartwright and Michael Courtney (attended for Claygate.


i. 3 Claygate Lodge Close, felling of Oak Tree. Objections from CPC and tree owner on grounds of amenity value and biodiversity. The officer was adamant that the applicant’s insurer had provided the acceptable level of evidence in accordance with normal guidance to show that the tree was the most likely cause of subsidence damage of 2 Claygate Lodge Close. Elmbridge therefore had no option as it would otherwise be exposed to massive claims. Moreover, the house was built (about 1970) when there was no clear structural guidance (1984) on building near large trees, so could not be deemed to be responsible for the problems. All members of the Committee were trying to find arguments to retain the tree (hence supporting the CPC view), but reluctantly agreed to fell. Michael Courtney thought the insurer’s estimate (£246,000) for underpinning costs was ridiculous – it was inflated by temporary accommodation costs. There is a condition to re-plant.

ii. 5 Merrilyn Close (2009/1297) LDC. CPC did not give a view. 6 letters of objection were received. Jimmy Cartwright said he had visited the neighbour who conceded that the application had to go through, having done all that was possible. Michael Courtney agreed without further comment. From the officer’s exhaustive description it is clear that permitted development is allowed in addition to any previous planning permission so, as in this case, a smaller planning application can be achieved, even though the total after topping up by the permitted development may be unacceptable (although in this case CPC Planning Committee accepted the total).


Cllr Huddart also noted:-

i. 2009/1199, two houses rear of 1 and 3 St. Mary’s Road, Ditton Hill, was convincingly refused against the officer’s advice, for failure to conform the HSG18 (access to backlands). The access is 3.1m, beside the frontage house, about 50m long, and would require bins to be wheeled to the front every week, and sprinkler or hydrant installation because it is too narrow for fire appliances. The two Claygate councillors voted to permit.

ii. 2009/1294, conservatory on show house of Government Buildings, Hinchley Wood, was convincingly refused against the officer’s advice because it took a dominant place in the middle of a meagre 11m deep garden for a 4-bedroom detached house. The Elmbridge Design Guide says that gardens “should not be reduced to token areas of land that make little contribution ‘to amenity’.


It was noted that there are no Claygate applications for the EA Sub-Committee meeting on 19 Oct 2009.

9. Enforcement

Outstanding enforcement actions:-

i. Shop front of the Londis
ii. The removed hedge and fence in the Recreation Ground.


10. Village Design Statement

10.1 The last meeting was on 5 Oct 2009. The final version has been produced containing the maps. This will be put on urgent circulation so that all councillors can see it prior to the Nov PC meeting, when the VDS needs to be approved.

10.2 The next phase of the VDS will be to work up the Special Planning Guidelines version for EBC. This will be done using the Woldingham VDS.

10.3 A run of 25 copies will cost about £7 each. It is not planned to give a copy to every resident. It is not known whether copies will be available to purchase. It will cost £70 for a licence to print the maps. The licence is valid for up to 3 months and 250 copies. Both types of VDS will probably be printed together so that only one licence fee has to be paid.


11. Matters for information only

11.1 An article will be included in the Courier about driveways. Most residents do not realize that Planning permission is required to alter a front garden to include a driveway and that these should be of a permeable surface to avoid ‘run-off’.

11.2 The hedgerow survey needs updating. When Noel has finished with the VDS she would be willing to assist in updating the information on Claygate hedges.
