Minutes.

 

Pre-application presentation

Prior to the meeting representatives from Young’s brewery and their architects came to give a presentation about their proposed plans for the Foley Arms PH.

 

Present:-

Visitors-Nick Hayward -RPS, Dan Marsh -Young’s, Steve Broughton- Young’s, Peter Nichols -RLB, Robert Adamson- ADS Design

 

Before the presentation Geoff Herbert informed the visitors that CPC is not the Statutory Authority, we can only make comment to this authority; EBC. The purpose of their visit was for us to listen to their proposal and possibly ask questions to clarify matters, but not to give any opinion. The visitors then gave the presentation.

 

They are selecting pubs in attractive areas as part of their ‘Inn with Rooms’ initiative. The Foley Arms is a good pub in an attractive location, and they hope to bring benefits to Young’s and the wider area.

It is hoped that the resultant will be an upmarket facility and improvements to the pub will also be carried out, but not in a modern, contemporary style, but traditional and good quality. It will remain a traditional pub with modern twists.

At the moment the pub is too small to cover both the drinking trade and the food trade, so the building will be expanded to cover both, together with the hotel trade. It is hoped that the local element will not be lost.

There will be 25 non-standard, quality rooms with quality furnishing in different styles. The price of the rooms will be in the order of £100 per night. It is anticipated that the week and weekend trade will target different markets; business people in the week and visitors to Claygate at the weekend.

There has been initial consultation with the Planning Officer, Rob Ellis, at EBC and the highway department at SCC. These initial discussions have been beneficial and the plans have been amended to take account of the comments form EBC. The proposed hotel block has been stepped down and kept away from the residential boundary.

Answers to questions:-

The materials proposed for the hotel block are matching brick at the bottom and white render at the top.

The car parking is not regular at the moment; there will be 25 proposed spaces.

The front area of the pub will be hard and soft landscaped.

The rooms will be B&B, so the restaurant will be open for breakfast.

Young’s are realistically looking at starting this venture next year.

 

The visitors left and the meeting began

1. Apologies for Absence

Cllr Alan Charlwood who had a business meeting. These were accepted.

 

2. Declarations of Interests

Cllr Huddart declared an interest in those applications in the Conservation Area, as he is Chairman of the Claygate Conservation Areas Advisory Committee (CAAC).

Cllr Cartwright declared a personal interest in the application for 41, Cavendish Drive as she is good friends with the residents at 43, Cavendish Drive.

 

3. Minutes of last meeting

The minutes of the last meeting on 10 July 2008 were taken and typed by Noel Isaacs. Thanks were given to Noel by the Committee.  They were confirmed and signed.

 

4.  Report of actioning of items from previous minutes

None

 

5.  Correspondence

5.1 Letters have been sent to all Planning Committee members by Gloria Balchin of Eastry House, Hillview Road asking to reconsider the application 2008/1570- The Cottage, Ruxley Heights which was dealt with at the last meeting. It was agreed that the letter had been studied but no new issues were raised. In fact, one of the issues was that the houses were set too far back. In terms of ‘how does this affect Claygate’, the Committee prefers to see houses set back from the road. During the last meeting, all aspects of the application had been looked at and no comments on the proposed buildings were made. It was agreed that the opinions of the Committee remained the same.

AP3 The Clerk to write to Gloria Balchin

5.2 An appeal in respect of 2007/2793-5, $ Chadworth Way has been received. This will be dealt with by exchange of written statements and a site visit. The Clerk has written to request a copy of the decision.

5.3 All results were read.

6.1 2008/1637-Scylla, Mountview Road 1.45m front boundary wall

No comment.

 

6.2 2008/1652 –2,3 & 4 , High Street replacement of shop fronts

Cllr Huddart declared an interest as this is in the Conservation Area.

It was agreed that the retrospective action was regretted, but the shop is welcomed. It is unlikely that any reinstatement of features could be asked for, as any damage to the buildings has already been done

6.4 2008/1676- 57, Foley Road TPO: EL: 04/50-2x lime (G1), 2x lime (G2)-reduce height by 6m, cut limbs back to boundary fence

6.5 2008/1693- 6, Rythe Road part single/part two storey front/side/rear extension plus new front porch

6.6 2008/1706- 137, St Leonards Road- single storey rear extension

6.7 2008/1718-14a, Stevens Lane- TPO: EL: 02/14 fell Corsican pine

This tree may not need felling immediately; however, if it is felled we ask that a replacement is planted.

 

 

6.8 2008/1749- 41, Cavendish Drive two storey rear and single storey side/front extensions

Cllr A Cartwright declared a personal interest as she is a friend of the residents at 43, Cavendish Drive who are objecting to the application. She remained in the room, but took no part in the discussion.

 

We ask the officer to check the 45° rule at the rear of the proposal to both neighbouring properties.

6.9 2008/1755- 22, Stevens Lane amendments to permission 2007/3033, including extensions to both plots

We object to this application as the gardens lengths will be insufficient to support 5-bedroomed houses, in particular, the garden length of Plot 1 will be inadequate.

 

6.10 2008/1767- 3, Oaken Drive LDC-proposed replacement garage

 

6.11 2008/1774- 55, Common Road two storey side extension, front & rear dormer windows after demolition of conservatory & garage.

We object to this application as:-

i.                                                                     It breaches the 1m rule along the whole side of the house to number 53.

ii.                                                                   There will be over-development of the site

iii.                                                                  The garden length will be totally inadequate for the proposed 6 bedroomed house

iv.                                                                 There will be no off-road parking

We ask the officer to check the 45° rule to number 53.

 

6.12 2008/1775- Breydon, Mountview Road detached two storey house with basement additional rooms in the roofspace and integral garage after demolition of existing house.

There were no comments on the proposed building, but the Tree Warden has not seen the plans. It was agreed to defer comment to EBC until the Tree Wardens had visited the site and made comment. The Clerk was authorised to send these comments to EBC.

The following comments of the Tree Wardens have been sent to EBC:-


There are no grounds for objection but the trees must be adequately  protected during demolition and building works. Protective fencing must be erected around all Root Protection Areas, especially sweet chestnut T1 and Hazel T5, and no activity or storage must take place within these areas.
It is important that the existing ground levels are maintained within the Root Protection Areas of all trees.  This is the proposal but it must be enforced. As the proposed building will require very deep excavation close to retained trees, it is desirable that these protective measures are monitored by an arboriculturalist during the development.  This should be a planning condition.

6.13 2008/1787- 86, Coverts Road rear dormer

No plans have been received for this application, so it will be deferred until the next meeting.

 

7.  Planning Letters

At the moment there is no delivery of CPC Planning letters and therefore, no notification that residents should send any comments on building applications to the Parish Council. This has resulted in residents such as Gloria Balchin requesting that the Planning Committee review their comments to EBC.

It was AGRREED that the letters are a service to the people of Claygate and good PR for the Parish Council.

The main problem is the lack of volunteers to hand-deliver the letters. It was suggested that the letters could be posted to immediate neighbours, the house across the road, and, if necessary, the house at the bottom of the garden.

The letter could be amended to include a request for those receiving the letter to inform other neighbours who may be affected, or the Parish Council who could then inform those neighbours.

Each application would then cost £1 in stamps, at an average of 5 applications per week; this would cost £260 per year.

Cllr Round volunteered to undertake sending out the letters.

The Clerk will amend the Planning letter and equip Cllr Round with stamps, envelopes and a map of Claygate.

8.  Report of the East Area Sub Committee

Cllr Charlwood was to attend this meeting, but mixed up the date.

Cllr Herbert printed the report of the meeting from the website. There was only one matter for Claygate:-

i.                     2008/1123- Cherry Hill, Mountview Road-permitted with the condition that the development be retained in a strict accordance with the approved plans.

 

 

9. Licensing Applications

None

 

10.  Enforcement Matters

 Outstanding matters-

  1. the oak tree in front of 28, Stevens Lane
  2. The front room of 109, Hare Lane-it was noted that this room is still in use contrary to Planning Permission.
  3. the middle corbel on the shop-front of the Bengal Lancer

These matters remain outstanding.

It was agreed at the last full Council meeting that the Clerk would write to Martin Parker about enforcement at 109, Hare Lane.

                                                                                                                                                        

11. Village Design Statement

11.1 A meeting took place with Cllrs Round and Herbert and Noel Isaacs.

11.2 The questionnaire is progressing, but the presentation needs work. It can be correctly typeset for printing. Cllr Round will get quotes for printing. It was queried as to who was sending out the questionnaire, CPC or the VDS Committee? At this stage, CPC is still steering the project, so the questionnaire should bear the CPC logo. Noel will send specimen questionnaires from other VDS to Cllr Round.

12. Training

12.1 Cllr Round contacted Martin Parker at EBC to request an ‘overview of planning’. This has been passed to Ian Maguire the Development Control Manager.  As Planning is a diverse topic, he suggests that
the discussion be limited to:

 1. Introducing the Planning System and Local Development Framework
 2. A summation of the legislative backing for Planning Control including;
      · the definition of development and need for planning permission
      · Permitted Development
      · Planning Considerations and Constraints
3. An overview of the procedures of making an application for planning permission.
4. The involvement of Statutory Consultees, such as the Parish Council in the Planning Decisions.
5. A summation of Planning Appeal and Enforcement proceedings

 He anticipates that an overview of this nature would normally take around 1-2 hours and will be held at the Civic centre. He requests that Cllr Round get back to him with dates and numbers.

12.2 It was noted that we would like to be informed of EBC internal training courses, so we can decide what is relevant.

12.3 This can be included in the proposed training strategy for CPC.

 

13. Matters for information only

13.1 It was noted that the application for floodlighting at Claygate Tennis Club will be discussed at the next meeting. It was agreed that a larger venue may be needed. Cllr Round will see if the SVH is available.

13.2 Cllr Herbert will speak to Cllr Sheppard about calling a public meeting for the Foley Arms PH.
